Section 8 of the Environmental Assessment Act (EA) 2000 requires any developmental activities/projects to obtain an Environmental Clearance (EC) unless exempted under the EA Act and its Regulation for Environmental Clearance of Projects 2016.
However, it has come to the notice of National Environment Commission Secretariat that some of the activities/projects are being implemented prior to issuance of an EC. This constitutes as a serious offense under the EA Act and Regulation.
In this regard, all are requested to strictly adhere to the legal requirements before commencing the activity. Henceforth, establishing, commencing or carrying out ofÂ activities/projects without the required EC shall be fined about equivalent to ten (10) times of the applicable application fees in addition to restoration of activities as per the EA Act and Regulation.
This notification is issued for strict compliance by the Competent Authorities and project proponents.
